1. About These Terms
1.1 Bloom Daily (bloomdaily.io) is an online marketplace operated by Big Jpresso Sdn Bhd, Bandar Sri Damansara, Kuala Lumpur ("Bloom Daily", "we"). These terms are an agreement between Bloom Daily and the business that sells on it ("you", the "Seller").
1.2 You accept these terms when you tick the box on the seller application, or when you first list a product, whichever comes first.
1.3 Bloom Daily sells your products to customers on your behalf. You remain the seller of the goods and are responsible for them; Bloom Daily runs the shop, takes the payment and passes you your share.
1.4 The seller guide explains how things work in practice. If the guide and these terms differ, these terms apply.
2. Joining Bloom Daily
2.1 Any food and beverage business may apply. Every application is reviewed, and Bloom Daily may approve or decline it at its discretion.
2.2 You must be a business registered in Malaysia (SSM) or another legal entity Bloom Daily accepts, and give true, current details: business name, registration number, address, contact person, phone and email. Tell us within 7 days if any of these change.
2.3 Your business name, SSM registration number and a contact email, phone number or address may be shown on your store page where the Consumer Protection (Electronic Trade Transactions) Regulations 2024 or other law requires it. Bloom Daily keeps your seller records for at least 3 years.
2.4 You sign in to the seller portal with the email address you applied with. Keep access to that mailbox secure; anything done from your signed-in portal is treated as done by you.
2.5 Your approval sets which product types your store may list (for example roasted coffee, green beans, equipment, pantry, F&B supplies). Ask Bloom Daily to add a type.
3. Your Listings
3.1 Every listing must be accurate: name, origin, weight or size, ingredients where relevant, price, photos and description must match what the customer receives.
3.2 You set your own prices. Prices are in Ringgit Malaysia and include any tax you are required to charge.
3.3 Photos must be of the actual product and must not carry prices, stock labels, discount badges or other sellers' branding.
3.4 Keep stock accurate. Use stock tracking in the portal, or delist a product (the "Delist" button) as soon as you cannot supply it.
3.5 Bloom Daily may edit a listing's presentation (category, layout, image size) and may hide or delist any listing that breaks these terms or that it reasonably believes is inaccurate, unsafe or unlawful. Where practical, we will tell you why.
3.6 Each listing must show the estimated delivery time. The dispatch time in 5.2 applies unless your listing states a longer one.
3.7 Where Malaysian law requires it, product names and key product information must also be given in Bahasa Malaysia (other languages may be added alongside). Bloom Daily will tell you when this applies to your listings.
4. Product Rules
4.1 You are responsible for your products being safe, lawful and fit to sell in Malaysia, and for holding every licence, registration and approval they need.
4.2 Food and drink must be labelled as Malaysian food law requires (including name, ingredients, net weight, manufacturer or packer details and date marking where applicable) and handled hygienically.
4.3 Halal. Describe a product as halal, or show any halal logo, only if you hold a valid halal certificate for it from JAKIM or a recognised certifying body. Send Bloom Daily a copy on request. Bloom Daily will remove halal wording it cannot verify.
4.4 Electrical equipment that needs SIRIM or other approval to be sold in Malaysia must have it.
4.5 Health claims. Do not claim a product treats, cures or prevents any illness.
4.6 Prohibited on Bloom Daily: counterfeit or copied goods; items you have no right to sell; alcohol; tobacco and vaping products; medicines and supplements with medicinal claims; expired goods; anything illegal to sell in Malaysia; and any other item Bloom Daily tells you is not allowed.
4.7 If a product is recalled or found unsafe, delist it immediately and tell Bloom Daily.
5. Orders, Dispatch and Shipping
5.1 When a customer pays, Bloom Daily notifies you (by WhatsApp to the phone in your Store settings) and the order appears under Orders in your portal.
5.2 Pack and hand the order to the courier within 3 working days of payment, unless the listing states a longer time.
5.3 Bloom Daily issues the courier AWB (shipping label) for each order. Hand the parcel to the courier from the pickup address in your Store settings.
5.4 Update each order's status in the portal (Confirmed, Roasting, Shipped, Delivered) and add the tracking number when you ship. Customers see this status.
5.5 Pack goods so they arrive in good condition. Loss or damage caused by poor packing is your responsibility; loss or damage by the courier after correct packing is handled with the courier by Bloom Daily.
5.6 If you cannot fulfil an order, tell Bloom Daily at once so the customer can be refunded (see section 7).
6. Money: Commission, Fees and Payouts
6.1 No listing fee. Listing products on Bloom Daily is free.
6.2 Commission. Bloom Daily keeps a flat 8% of the price of each item sold, counted on the full item price before Bloom Rewards credit and discount codes. Bloom Daily will give 30 days' notice before changing the rate.
6.3 Card and payment fees are paid by Bloom Daily and are not deducted from you.
6.4 Bloom-funded discounts (Bloom Rewards credit, referral and discount codes issued by Bloom Daily) are paid by Bloom Daily. Your share is calculated on the full price.
6.5 Shipping charged to the customer is kept by Bloom Daily, which pays the courier. Payout: each month's net amount (item sales less commission, refunds and any amount under 7.4) is paid by bank transfer to your Malaysian business bank account by the 7th of the following month. Balances under RM50 roll over to the next month.
6.6 New sellers: the payout for your first month's orders is held until 30 days after your first order, to cover early returns and disputes.
6.7 A monthly statement in the portal (Statements, with CSV download) shows your gross sales, commission and net payable. Raise any query within 30 days of the statement.
6.8 Taxes. You are responsible for your own taxes on your sales, including any SST you must charge. Bloom Daily will issue you an invoice (or e-invoice, where required) for its commission.
7. Cancellations, Refunds, Returns and Chargebacks
7.1 Before dispatch, a customer's cancellation, or an order you cannot fulfil, is refunded in full and no commission is charged on it.
7.2 Wrong, damaged, faulty or not-as-described items are your responsibility: you replace the item or the customer is refunded, including return shipping. Bloom Daily decides the outcome for the customer after hearing from both sides.
7.3 Change-of-mind returns are not accepted for coffee and food once shipped, and accepted for equipment that is unused and sealed within 7 days of delivery.
7.4 Refunds and chargebacks after a payout. If Bloom Daily refunds a customer or loses a card chargeback on your item after paying you for it, the amount you were paid for that item (your share after commission) is deducted from your next payout. If that payout is too small, you repay the balance within 14 days of Bloom Daily's request.
7.5 Send Bloom Daily any evidence it asks for (photos, tracking, correspondence) within 3 working days so it can defend a dispute.
7.6 Customers raise complaints with Bloom Daily (WhatsApp +60 11-4036 6833 or hello@bloomdaily.io). Bloom Daily passes them to you; reply within 2 working days.
8. Customer Data and Dealing Directly with Customers
8.1 For each order you receive the customer details needed to deliver it (such as name, address and phone). This is personal data under Malaysia's Personal Data Protection Act 2010.
8.2 Use customer data only to fulfil that order. Do not use it for marketing, add it to your own mailing or WhatsApp lists, sell it or share it, unless the customer has separately given you permission directly.
8.3 Keep the data secure and delete it when you no longer need it for the order, returns or your legal records. Tell Bloom Daily within 24 hours if you suspect it has been lost, stolen or misused, so Bloom Daily can notify the Personal Data Protection Commissioner within the 72 hours the law allows.
8.4 No going around Bloom Daily. You must not invite a customer you met through Bloom Daily to buy from you directly to avoid Bloom Daily (for example by putting your WhatsApp number or discount offers in the parcel or messages). This does not stop customers who already knew your business.
9. Photos, Brand and Content
9.1 You keep ownership of your photos, logo, text and brand.
9.2 You give Bloom Daily a free, non-exclusive licence to use them on bloomdaily.io, in share previews, and in Bloom Daily marketing (social media, ads, emails) to promote your products and store, for as long as you sell on Bloom Daily and for a reasonable time after for content already published.
9.3 You confirm you have the right to use everything you upload, and that it does not infringe anyone else's rights.
10. Suspension and Ending
10.1 Bloom Daily may warn you, hide listings or suspend your store if you break these terms, if more than 10% of your orders in a month ship late or are cancelled by you, if customers repeatedly complain about your products, or if Bloom Daily reasonably suspects fraud or unsafe goods.
10.2 For serious breaches (for example fraud, unsafe or illegal goods, misuse of customer data, false halal claims) Bloom Daily may close your store immediately.
10.3 Bloom Daily may also close your store for any other reason with 30 days' written notice.
10.4 You may close your store with 14 days' notice. Complete or refund all open orders first.
10.5 After closing, Bloom Daily pays what it owes you by the next payout date, after holding back any amount needed for refunds or disputes on your past orders for up to 60 days. Sections 7, 8, 11 and 12 continue to apply.
11. Responsibility and Liability
11.1 You are responsible for your products and listings, including their safety, labelling, halal status and legal compliance, and for delivering what you sell.
11.2 You will cover Bloom Daily for losses, fines and reasonable legal costs caused by your products, your listings, your breach of these terms or your breach of the law (including the Personal Data Protection Act).
11.3 Bloom Daily is not liable for indirect losses (such as lost profits or lost business). Its total liability to you in any 12 months is limited to the commission Bloom Daily earned from your sales in the 3 months before the claim, except where the law does not allow that limit. The limit never reduces payouts Bloom Daily owes you.
11.4 Bloom Daily aims to keep bloomdaily.io available but does not guarantee it will always be available or error-free.
12. Changes, Governing Law and Contact
12.1 Bloom Daily may update these terms. It will email you at least 14 days before a change takes effect (30 days for a change to the commission rate). Continuing to sell after that date means you accept the change; otherwise you may close your store under 10.4.
12.2 These terms are governed by the laws of Malaysia, and the courts of Malaysia have jurisdiction.
12.3 If one part of these terms cannot be enforced, the rest still applies.
