Terms & Conditions

Welcome to Bloom Daily. These Terms and Conditions ("Terms") govern your access to and use of the Bloom Daily marketplace, including the website at bloomdaily.io and any related services (collectively, the "Platform"). The Platform is owned and operated by Big Jpresso Sdn Bhd ("Bloom Daily", "we", "us", or "our").

By accessing, browsing, registering an account, placing an order, or selling on the Platform, you ("you", "User", "Buyer", or "Seller" as applicable) agree to be bound by these Terms. If you do not agree, you must not use the Platform.

1. Definitions

• Buyer — any User who places an order for Products through the Platform.
• Seller — any merchant authorised to list and sell Products on the Platform (e.g. Jpresso, Cloud Catcher, LewisGene, Richman, Beansology, and other approved partners).
• Products — coffee, green beans, equipment, and related goods listed for sale by Sellers on the Platform.
• Order — a confirmed purchase request submitted by a Buyer through the Platform.
• Stripe — Stripe Payments Malaysia Sdn Bhd, our third-party payment processor, including Stripe Connect for seller payouts.

2. Marketplace Role

Bloom Daily operates as an online marketplace platform that connects independent Sellers with Buyers. Except for Products listed under the "Jpresso" brand, Bloom Daily is not the seller of the Products listed on the Platform. The contract of sale for each Order is concluded directly between the Buyer and the Seller of the relevant Product.

Bloom Daily facilitates discovery, ordering, payment processing, and dispatch coordination, but does not warrant or guarantee the quality, safety, legality, or accuracy of listings created by third-party Sellers, except where required by Malaysian law.

3. Eligibility & Account Registration

1. You must be at least 18 years of age and legally capable of entering into binding contracts under Malaysian law to use the Platform.
2. You agree to provide accurate, current, and complete information during registration and to keep your account details updated.
3. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
4. We reserve the right to suspend or terminate any account that violates these Terms or that we reasonably believe is being used for fraudulent, unlawful, or abusive purposes.

4. Products, Listings & Pricing

1. All Products, prices, descriptions, and availability are subject to change without notice. Prices are listed in Malaysian Ringgit (MYR) and are inclusive of applicable taxes unless otherwise stated.
2. While we and our Sellers take reasonable care to ensure listing accuracy, we do not warrant that descriptions, images, weights, or roast profiles are free from error.
3. If a pricing or listing error is discovered after an Order is placed, Bloom Daily or the Seller may cancel the affected Order and issue a full refund.
4. Stock availability is not guaranteed until payment is confirmed and the Order is accepted by the Seller.

5. Orders & Payment

1. By placing an Order, you make a binding offer to purchase the selected Products at the displayed price plus applicable shipping fees.
2. Payments are processed securely through Stripe. Bloom Daily does not store full card or bank credentials on its servers.
3. Accepted payment methods may include credit/debit cards, FPX (online banking), and other methods supported by Stripe at the time of checkout. Some methods may be restricted for certain product types.
4. An Order is only confirmed once payment is successfully captured and an order confirmation email is sent.
5. Bloom Daily collects payment on behalf of Sellers via Stripe Connect and remits the seller's share after deducting an 8% platform commission and any applicable Stripe fees.

6. Shipping & Delivery

1. Peninsular Malaysia: Free standard shipping on all Orders.
2. East Malaysia (Sabah & Sarawak): Flat shipping fee of RM15 per Order.
3. Estimated delivery times are provided in good faith but are not guaranteed. Delays may occur due to courier performance, weather, customs, or events outside our control.
4. Risk of loss and title for Products pass to the Buyer upon delivery to the courier or the address specified at checkout, whichever occurs first.
5. It is the Buyer's responsibility to provide an accurate and complete delivery address. Reshipment costs arising from incorrect addresses are borne by the Buyer.

7. Returns, Refunds & Cancellations

1. Due to the perishable nature of coffee and food products, Bloom Daily generally does not accept returns of opened or consumed Products.
2. If a Product arrives damaged, defective, or materially different from its listing, you must contact us within 7 days of delivery with photographic evidence. Eligible cases will be resolved by replacement, store credit, or refund at our discretion.
3. Equipment may be returned within 7 days of delivery if unused, in original packaging, and in resalable condition. Return shipping costs are borne by the Buyer unless the item is defective.
4. Refunds are processed back to the original payment method via Stripe and may take 5–10 business days to reflect, depending on your bank.
5. Order cancellations are only possible before the Seller dispatches the Product. Once dispatched, cancellation is no longer guaranteed.

8. Subscriptions (Where Applicable)

1. Subscription Orders renew automatically at the interval selected at checkout until cancelled by the Buyer.
2. You may pause, modify, or cancel your subscription at any time via your account dashboard or by contacting us before the next billing date.
3. Subscription pricing may change with at least 14 days' prior notice. Continued use after the effective date constitutes acceptance.

9. Seller Terms

The following additional terms apply if you are a Seller listing Products on Bloom Daily:

1. You warrant that you have all rights, licences, and approvals required to sell the Products, including compliance with Malaysian food safety, halal (where claimed), labelling, and consumer protection laws.
2. You are solely responsible for the quality, packaging, dispatch, and post-sale support of your Products.
3. You authorise Bloom Daily to collect payment from Buyers on your behalf via Stripe Connect, deduct the 8% platform commission and Stripe processing fees, and remit the balance to your designated bank account.
4. You agree not to circumvent the Platform by directing Buyers to off-platform transactions for Products discovered on Bloom Daily.
5. Bloom Daily reserves the right to remove listings, suspend Seller accounts, or withhold payouts in cases of suspected fraud, repeated complaints, or breach of these Terms.

10. Acceptable Use

You agree not to:

• Use the Platform for any unlawful, fraudulent, or harmful purpose.
• Post false, misleading, defamatory, or infringing content.
• Attempt to gain unauthorised access to any part of the Platform, other accounts, or our infrastructure (including Supabase databases).
• Use bots, scrapers, or automated tools to harvest data, place Orders, or interfere with normal operation.
• Resell or redistribute Products purchased on the Platform without express written authorisation from Bloom Daily and the relevant Seller.

11. Intellectual Property

1. All content on the Platform — including the Bloom Daily and Jpresso names, logos, brand colours (purple #4E1F73 and gold #DAB07B), product photography, copy, and the Sophia AI persona — is owned by Big Jpresso Sdn Bhd or its licensors and is protected by Malaysian and international intellectual property laws.
2. Sellers retain ownership of their own product imagery and brand assets but grant Bloom Daily a non-exclusive, royalty-free licence to display, market, and promote them on the Platform and related channels.
3. You may not copy, reproduce, or commercially exploit any Platform content without prior written consent.

12. Privacy & Data

We process personal data in accordance with the Personal Data Protection Act 2010 (Malaysia) and our Privacy Policy. By using the Platform you consent to the collection and processing of your data as described therein, including for order fulfilment, payment processing via Stripe, and communications.

13. Disclaimers

The Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Bloom Daily disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or secure at all times.

14. Limitation of Liability

1. To the maximum extent permitted by law, Bloom Daily's total aggregate liability arising from or in connection with your use of the Platform shall not exceed the total amount paid by you for the Order giving rise to the claim.
2. In no event shall Bloom Daily be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.
3. Nothing in these Terms limits liability that cannot be lawfully excluded under Malaysian law.

15. Indemnity

You agree to indemnify and hold harmless Bloom Daily, its directors, employees, and partner Sellers from any claim, loss, or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Platform, or your violation of any law or third-party right.

16. Suspension & Termination

We may suspend or terminate your access to the Platform at any time, with or without notice, if we reasonably believe you have breached these Terms or applicable law. Upon termination, your right to use the Platform ends immediately, but provisions relating to payment, intellectual property, liability, and governing law shall survive.

17. Changes to These Terms

We may update these Terms from time to time. The latest version will always be posted on this page with a revised effective date. Material changes will be communicated via email or a prominent notice on the Platform. Continued use after changes take effect constitutes acceptance.

18. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of Malaysia. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Kuala Lumpur, Malaysia.

19. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
